Send the Texas draftClubs outside Dallas and Fort Worth are still in this read with us. We are all Texans. The May franchise report follows the entity, wherever the studio floor is. Nobody has to carry a folder into a building. We read that January file on a shared screen and leave the building out of it.
Klyde Warren Park is the deck park over Woodall Rodgers, and the gates open early and stay open late. We share that early start the way any Texan does, and a studio that unlocks before breakfast still has to split the draft. The M-Line streetcar runs on McKinney Avenue on a route with a set time. A live class works like that route when a person guides the hour, and that hour stays out of the taxable amusement number.
A membership or an admission fee that lets someone use the gym between classes is subject to Texas sales tax. A studio whose customers cannot enter except for a scheduled class is not selling open gym admission. That distinction is Comptroller letter 202002030L. If the membership includes open gym, the membership is taxable even when some classes would have been nontaxable on their own.
Initiation fees and membership fees for gyms, athletic clubs, health clubs, and physical fitness studios are taxable in Texas as an amusement service. The Comptroller published that rule in its February 2022 tax policy news, aimed at the January rush of new memberships. Parking lots fill after the first of the year because getting healthy is a common resolution. That is the month the dues and the tax stack together.
Personal training is not taxable as an amusement service when the charge is stated separately from the membership and the training is one person at a time with the trainer directing the client through the workout. A fee for designing a program and explaining the machines, without directing the session, does not meet that test. The February 2022 note also says the live class taught virtually is not taxable, and a recorded session sold by a gym or studio is taxable. The Comptroller's examples include cycling, Pilates, yoga, Zumba, and Jazzercise.
Dietary and nutritional supplements that meet the Comptroller's definition are exempt. A gym that sells shakes, apparel, or other taxable goods still collects tax on those goods. The supplement exemption does not cover the membership.
Massage services sold by a massage parlor are a taxable personal service. Massage performed by a massage therapist who holds the Texas massage credential, or by a physical therapist, is outside that taxable category. Texas does not issue a general state credential to operate a gym. A sales tax permit is required because taxable amusement services are being sold. Massage credentialing sits at the Texas Department of Licensing and Regulation, separate from sales tax and separate from a cosmetology credential.
For the 2026 franchise report the no tax due threshold is 2,650,000 dollars and the due date is May 15. The rate is 0.75 percent unless the entity qualifies as a retailer or wholesaler at 0.375 percent. A studio that sells workouts rather than goods is in the 0.75 percent category unless the retail test in the instructions is actually met. Even with no tax due, the franchise instructions still want the information report. A federal disregarded election still leaves that Texas information report on the calendar. The rate waits until the election has a name.
State sales tax is 6.25 percent and local tax can add up to 2 percent, so a taxable membership is taxed at as much as 8.25 percent. A seller must state the tax separately or meet the tax included notice rules. If the agreement buries the tax, the tax is backed out by dividing the price by one plus the rate. A card fee the gym adds onto a taxable membership is part of the taxable price. Webfile is the Comptroller filing system, and paper sales tax returns stop being available after prior year tax reaches 50,000 dollars. Form 7004 can push the federal entity return later in the year. The Texas franchise report in May does not ride along with that push.
The Dallas Marathon, the oldest in Texas, loops White Rock Lake in December. White Rock Lake holds back White Rock Creek before that water reaches the Trinity. Every Texan knows that long effort. December is when the year can still be read, before the January draft sits in the books, and a membership year is a long loop unless Publication 538's tests are met.
Annexation in 1903 folded Oak Cliff into Dallas, and neighbors still say the old town name out loud. A dues line should keep its name the way that town name kept its name. Deep Ellum still draws a crowd to Trees, The Bomb Factory, and Club Dada when a set time is posted on the door. A class with a posted time is a live hour. A class with no set time is a recording.
Between Mercedes and Belmont, Greenville Avenue is the restaurant run people call Lower Greenville. One draft line that hides three charges is that avenue with the room names painted over. Bishop Arts is the block of independent shops in north Oak Cliff. A studio is not a shop just because a bottle is on a shelf. Dallas Love Field is the close in airport, about six miles northwest of downtown, and it is where Southwest Airlines started. A short call still needs a time, and nobody is asked to visit the club.
A medical campus now sits near the barbecue pit Sonny Bryan opened in 1958. Texans talk about a counter that never switched jobs. A month that has been split should feel as steady as that old counter. The sidewalk outside the Joule carries a sculpture large enough to see from across the street, and people call it Eye. A citation on a gym page should be that easy to spot, with the Comptroller letter or the IRS publication in the same breath as the number.
When someone in Dallas says Central, they mean Central Expressway, the name for U.S. 75 running north. A form should be that plain. Trinity Groves is the restaurant yard at the foot of the Margaret Hunt Hill Bridge. A first call is one table in that yard, and the letter is the rest of the scope. The Dallas Streetcar crosses the Houston Street Viaduct from downtown into Oak Cliff and continues toward Bishop Arts. These pages should tell you the next stop the way that line does. In the fall, the Dallas Arboretum sets out a Pumpkin Village. A credit should be that easy to find, sitting on the page that uses the picture. A photograph of a city outside Texas is not used here as a stand-in for a studio.
Name the month and whether members can walk in between classes.
