Fitness Studio or Gym Books CleanupFour questions a January draft raises.

Live class, one to one training, the annual draft, and the bottle.

Ask your own question

Is a live yoga class taxed like open gym.

A live class at a set time with the instructor guiding it is a different line from an open door. Cycling, Pilates, yoga, Zumba, and Jazzercise are the class names a draft usually carries. The same live hour taught on a video call, while someone is guiding it, stays that live line. Open gym is the other answer. If members can walk in whenever they like, the membership follows the open door even if a yoga hour is bundled into it.

A class with a clock on the door is a live hour. A class with no set time is a file someone plays later, and that file is the recording line on the draft.

When is personal training outside amusement tax.

Three facts have to show together on the invoice. The charge is stated separately from the membership. The training is one person at a time. The trainer directs that person through the workout. Drop any one of them and a state that asks for all three cannot see the hour. A fee for writing a program and pointing at the machines, with no directed hour, fails the third fact.

The invoice is the proof. If the training is a sentence inside the dues item, it is not stated apart. If two people share the hour, it is not one person. If the trainer handed over a sheet and left, the hour was not directed. We read the invoice before we read the marketing page.

Is a January annual draft income when received.

On the cash method, yes, unless Publication 538's tests for deferring an advance are met. Gross income includes what you actually or constructively received. An advance for services is generally income in the year it arrives. Spreading an annual fee across twelve months of liabilities is a different method, and blogs that do it are not describing Publication 538.

The sales tax return does not follow the bank's idea of a year either. The taxable part of those dues is in the taxable sales number for the month the cash arrived. Income and tax can both show up before most of the visits happen. That is the month owners go looking for a way to read the draft.

Are all bottles at the counter exempt.

No. Dietary and nutritional supplements that meet the definition are exempt. Shakes, apparel, and other taxable goods are not. The exemption does not leak onto the membership. A shelf that treats every bottle as one item will either overpay or underpay, and both mistakes show up when the return is tied to the deposit.

Send the retail items sold in the same month as the draft. Prices can be covered. The labels cannot. We need to see which bottle is a supplement and which bottle is a shake.

Where a trainer's pay belongs.

For payments made in 2026, Form 1099-NEC is the form for 2,000 dollars or more paid for services by someone who is not an employee. Before 2026 the threshold was 600 dollars. The job title does not decide the form. Control over how, when, and where the work is done is the common law test.

This practice does not run payday. If the person is an employee, setup lives on the provider the studio already runs. If the person meets the contractor test, the information return is the question on the table. Names can stay covered. The pattern of control cannot.

Which massage credential changes the fee.

A gym that adds a massage room has to know who performed the hour before the fee is grouped with the dues. Say the credential that was in the room. The fee can stay covered. The credential and the sales category are two questions.

A sales tax permit, where the state requires one for taxable services, is a different paper from a professional credential. Massage credentialing, where a state keeps it, sits apart from sales tax and apart from a cosmetology credential. Say who was in the room.

Ask the question the draft raised.

One question is enough. The month can come with it.
